    The debate essentially boils down to frequency usage and for me, if the frequency is in use, then one must leave the frequency. Additionally, valuable services like the NCDXF provide real-time propagation data for thousands while advancing science. However, no one has ownership of any frequency within our allocations. We might consider Amateur Radio Best Practices and adhering to our band plan(s) is a good best practice for me.

    However the frequency in use issue is a little different in this case, because you have a series of stations that transmit in a continuous cycle, however a listening station may not be able to hear a beacon station if the band isn’t open.

    That being said, the service provided in my opinion is of more benefit to a greater number of radio amateurs than me having the right to call CQ on 14.100. It’s not that hard to QSY down or up a few kcs.

    The debate for me boils down to the fact that the IARU Region II designated those frequencies for beacons and the FCC has continuously stated that band plans while not mandatory, are good operating practice in accordance with 97.101

    Futhermore, in some countries, it is radio law that they abide by those IARU band plans. Here in the US, the FCC doesn’t make it a matter of law, but they refer to it continuously in their enforcement actions.

    97.101 states:
    Sec. 97.101 General standards.

    (a) In all respects not specifically covered by FCC Rules each
    amateur station must be operated in accordance with good engineering and
    good amateur practice.
    (b) Each station licensee and each control operator must cooperate
    in selecting transmitting channels and in making the most effective use
    of the amateur service frequencies. No frequency will be assigned for
    the exclusive use of any station.
    (c) At all times and on all frequencies, each control operator must
    give priority to stations providing emergency communications, except to
    stations transmitting communications for training drills and tests in
    RACES.
    (d) No amateur operator shall willfully or maliciously interfere
    with or cause interference to any radio communication or signal.

    So…… does 97.101 give beacon operators sole use of those frequencies? No. 97.101(b) says that no station has exclusive use of a frequency. However 97.101(a) states good operating practice is to be employed by hams, which the FCC has said band plans are.

    Does 97.101(b) give other stations license to QRM the beacon stations? No again. 97.101(d) prohibits intentional QRM.

    I think we both are in agreement we just view the process to the end result a little differently Scot.
