My take on the FCC’s denial is that they have made their regulatory position clear, and since there is already court precedent in favor of enforcement of their regulatory position, they expect that courts will make the proper ruling.
A ham who has an adverse regulatory result needs to appeal to the federal district court having jurisdiction over the locus of the dispute, after exhausting all applicable nonjudicial relief available in that district. It’s probably better to appeal to the federal courts than to the state courts, because the federal courts are more likely to be swayed by the existing federal precedents.

I hope you are right. Like I said I am not a lawyer and dont know all the legal precedents. My concern is that the ARRL has done a lot for ham radio and I applaud them for doing so, because without them, we would not have what we have, but the BPL issue has strained relationships between the ARRL and the FCC and I was just curious if that had any bearing on the case.
Basically in other words instead of relying on PRB-1 to be a preprocess tool, you see it as a litigous tool to be used on appeal…….
I think most hams including me, have always had a different interpretation, and that interpretation was that PRB-1 was a preemptory tool for a ham to use in a ham-hostile government settings to get on the air initially, and not as a appellete tool.

PRB-1 should be backed up by the FCC to some extent. Sure a ham can appeal to various courts but how many of us have the resources to do so. The local authorities know not many amateurs will be able to pursue the issue so “no antenna for you buddy”.
Perhaps the government as a whole wishes amateur radio would go by the wayside.
